Firefighters Print & Design – Terms & Conditions
1. Introduction
Welcome to Firefighters Print & Design. By placing an order with us, you agree to the following terms and conditions. These policies ensure transparency and protect both parties in the production process. If you have any questions, please contact us before placing your order.
2. Intellectual Property, Copyright & Trademark Policy
a. Client Responsibility for Intellectual Property:
Clients are responsible for ensuring that they have the legal right to use all images, logos, text, and other materials (collectively referred to as “materials”) provided to Firefighters Print & Design for production. By submitting materials, you affirm that:
· You own or have obtained proper licenses for all intellectual property used in your design.
· You understand that unauthorized use of copyrighted or trademarked materials may result in legal action.
· You assume full liability for any claims arising from the use of unauthorized materials.
b. Firefighters Print & Design Role:
· We do not verify the legal status of submitted materials.
· We do not provide legal advice regarding copyright or trademark usage.
· If we suspect a design contains unauthorized content, we may:
o Request written permission from the rights holder
o Decline the job if we believe it poses a legal risk.
c. Indemnification Clause:
Clients agree to indemnify, defend, and hold harmless Firefighters Print & Design, its employees, and affiliates from any legal claims, damages, or costs arising from or related to the use of unauthorized materials.
d. Fair Use & Parody Disclaimer:
Fair use laws are complex and determined on a case-by-case basis. In the event there is a claim or challenge to materials Firefighters Print & Design produced, client is solely responsible for asserting the affirmative defense(s) of fair use or parody or any other available defense. It is the client’s responsibility to seek legal advice and provide written documentation supporting their claim.
e. Consequence of Violation:
If a legal claim is made regarding a printed design, Firefighters Print & Design will comply with legal authorities and the rights holder. The client assumes responsibility for any legal consequences and related costs, including attorney fees and costs incurred to defend and indemnify the Firefighters Print & Design.
f. Proprietary Work:
Firefighters Print & Design retains full copyright ownership of all original creative works produced unless otherwise agreed upon.
Original creative works include, but are not limited to, graphic design, photography, illustration, and any other content created by Firefighters Print & Design.
Firefighters Print & Design reserves the right to display completed work in our portfolio, marketing materials, and online platforms unless a confidentiality agreement is signed.
3. Political Mailers & Disclaimers
Client Responsibility for Legal Compliance:
Political mailers are subject to specific legal requirements imposed by State and local law. Firefighters Print & Design does not provide legal guidance or verification of political disclaimers. By ordering political mailers, you acknowledge and agree that:
· You are responsible for ensuring that all disclaimers meet the legal requirements of State and local law.
· Firefighters Print & Design is not liable for any issues related to non-compliance disclaimers.
· We strongly recommend consulting an attorney to verify compliance.

4. Rush Order & Late Fees Policy
· Rush fees may be applied to projects requiring expedited turnaround, defined as completion within a timeline shorter than our standard processing schedule.
· All rush requests are subject to approval based on current workload and resources available.
· Rush fees are non-refundable once work has begun.
· Projects requiring after-hours or weekend work may incur additional charges.
Rush Fee Structure
Design Services
Small changes or quick updates to previous jobs, as well as simpler tasks like single digital graphics, will not typically incur a rush fee.
Applies to larger, more complex projects, such as multi-page designs, new campaigns, or significant redesigns, requested within a shortened timeline.
For larger projects, the rush fees may be as follows:
· 3-4 business days: Additional 25% of project cost
· 1-2 business days: Additional 50% of project cost
· Same-Day Service: Additional 100% of project cost (subject to availability).
Late Proof Approvals & Production Delays:
Failure to approve proofs on time may delay production. Rush fees do not guarantee delivery times if delays occur due to late approvals.
5. Order Process & Approvals
a. Proofing Process:
Clients must review and approve digital proofs before production. Errors in the final product that were present in an approved proof are the client’s responsibility.
b. Final Approval Requirement:
Once a proof is approved, no further changes can be made, and Firefighters Print & Design is not responsible for any overlooked errors.
c. Estimated Turnaround Time:
Standard production timelines vary depending on the product. Delays due to third-party vendors, material shortages, or shipping issues are outside our control.
6. Payments, Cancellations & Refunds
a. Payment Terms:
A deposit may be required before production begins. Full payment is due upon completion unless otherwise agreed.
b. Cancellation Policy:
Orders canceled before production are subject to a cancellation fee. Once production begins, cancellations are not permitted, and full payment is required.
c. Refund & Reprints:
Refunds may be issued only if a product is defective due to a printing error on our part. If an error is client-approved (e.g., typos in proof), reprints will be charged at the full rate.
7. Shipping & Delivery
a. Estimated Delivery Times:
Delivery dates are estimates and not guaranteed unless explicitly stated.
b. Carrier Delays:
Once an order has been handed over to the shipping carrier (e.g., USPS, UPS, FedEx), Firefighters Print & Design is not responsible for delays, lost packages, or damage caused by the carrier. Any shipping delays due to carrier processing times, weather, or other external factors are outside our control.
c. United States Postal Service (USPS) Processing Times:
USPS delivery times are estimated and not guaranteed. Once a package is in USPS possession, we cannot expedite or alter the shipping process.
d. Clients Responsibility for Address Accuracy:
Clients must ensure shipping addresses are correct. An incorrect address may result in additional fees.
e. Clients Responsibility for Receiving Shipment:
Client must ensure someone will be able to receive the shipment on the delivery date. Deliveries requiring more than one delivery attempt may result in additional fees.
8. Liability & Indemnification
a. Limitations of Liability:
Firefighters Print & Design is not responsible for indirect damages, including lost revenue or reputational harm, resulting from errors or delays.
b. Client Agreement to Hold Harmless:
Clients agree to release Firefighters Print & Design from liability arising from or related to the content of printed materials. Printed materials is to be broadly construed to include, but not be limited to, logos, images, text and other materials. In the event any claims arise related to any material produced by Firefighters Print & Design, Client agrees to hold Firefighters Print & Design harmless. The client further agrees to defend and indemnify Firefighters Print & Design.
9. Union Bug Policy
a. Use of the Union Bug on Printed Materials
As a union print shop, all printed materials produced by Firefighters Print & Design will include our official union bug unless the client explicitly requests its removal.
The union bug signifies that a product was printed by a certified union shop and may not be used on materials not produced by Firefighters Print & Design.
b. Use of the Union Bug on Promotional Products
The union bug cannot be printed on imported products.
c. Prohibited Use of the Union Bug
Clients are not permitted to take, replicate, or use the union bug for any printing or digital purposes outside of work produced by Firefighters Print & Design.
The union bug will not be included on digital files or designs to prevent unauthorized use.
If a client has specific requirements regarding the placement or removal of the union bug, they must notify us before production begins.
